What to Do in the Event of an Accident

  • Immediately notify police - Contacting the local or state authorities immediately is extremely important. The investigating officer will create an accident report that will hold crucial information and evidence that will assist us in your case. The officer may speak with the other vehicle operator and receive statements that can be used against the other person during a trial. Do not to move the cars after an accident unless your vehicle presents a hazard for other drivers approaching the scene. Make note of the investigating officer's name, badge number, and jurisdiction.
  • Exchange information with the other driver - The police will gather identification and insurance information from all involved parties. If the police are not called to the scene, you need to obtain the other driver's name, address, and policy number/name of insurance company. Check their drivers license, registration, and insurance card, and copy all information including the driver's name, address, and ID number.
  • Make no statement - Other than exchanging information with the other driver, do not make any statements or have a discussion with the other driver regarding who was at fault. Do not enter an argument with the driver - if you say something inaccurate, the statement can be used against you in a trial. Simply tell the responding officer your account of the event.
  • Speak with witnesses - When/if other motorists stop at the accident scene, ask if they witnessed the accident. If they did, try to get their name, address, and telephone number. See if they would remain at the scene and provide a statement to the police.
  • Obtain pictures of the accident scene, your injuries, and all involved vehicles - Get pictures immediately, as having pictures helps to prove the severity of the accident's impact as well as the degree of your pain and suffering.
